Cannabis laws in Australia

Medical only

Tourists cannot buy recreational cannabis legally anywhere in Australia, and the ACT's personal-use rules are not a national allowance.

Official sources checked November 7, 2026. This is news information, not legal advice. Laws and local penalties change — confirm with the destination's official sources before you travel.

Before you fly

Carrying cannabis across a border is treated separately from possessing it inside the country. Even where buying is legal, taking it onto a plane can be a customs or smuggling offence, and a domestic flight can become an international one the moment you connect somewhere else.

Current law at a glance

Buying as a visitor
There is no legal recreational retail market. Visitors can consult an Australian registered prescriber; clinically appropriate medicinal cannabis is dispensed through pharmacies, with national and state or territory approvals where required. A foreign prescription is not automatically an Australian dispensing prescription.
Possession
There is no national recreational possession allowance. ACT territory protections for adults aged 18 and over cover up to 50 grams dried or 150 grams fresh cannabis, but federal prohibitions remain relevant. That is not a nationwide allowance and does not authorize buying, selling or sharing.
Smoking in public
Recreational public use is not generally lawful, and the ACT protections do not extend to public consumption. Penalties and smoke-free or vaping rules depend on the jurisdiction. A current nationwide fine and a complete state-by-state penalty schedule were not verified.
Home growing
ACT territory protections cover two plants per adult and at most four per household, subject to cultivation, security and child-protection restrictions, with hydroponic or artificial cultivation excluded. Federal law still matters, other jurisdictions differ, and no national tourist growing entitlement exists.
Medical cannabis and carrying medicine
Border guidance allows up to three months of prescribed medicine carried by a traveler for personal use or an accompanying immediate family member, with a prescription or doctor's letter, original packaging and readiness to declare it. Confirm the specific cannabis formulation before you fly. This traveler route is distinct from ordering cannabis or CBD by post, which the border force says the personal-importation scheme does not authorize.
Borders and CBD
Unauthorized cannabis or CBD imports can be seized and lead to prosecution, fines or imprisonment, though exact cannabis-specific sentencing thresholds were not verified. Taking medicine out also requires destination and transit compliance, and CBD is not universally an unrestricted consumer product.

Practical questions

Can I buy weed as a tourist in Australia?

Not recreationally. Seek an Australian prescription and pharmacy dispensing if medically appropriate; a vape shop or convenience store is not a lawful medicinal supplier.

Can I carry 50 grams anywhere in Australia?

No. The 50-gram dried and 150-gram fresh provisions concern the ACT, not the whole country, and federal law remains relevant.

Can I smoke on the street?

Do not assume so, even with a prescription. Public recreational use is excluded from the ACT protections, and local smoke-free and vaping restrictions also apply.

Can I bring prescribed cannabis into Australia or fly home with it?

Potentially under the carried-medicine traveler exemption, normally up to three months with supporting documents — confirm the product first. Postal imports follow different rules, and your home and transit countries must independently permit any medicine you take out.

What about CBD?

Do not treat CBD gummies or oils bought overseas as freely importable. The border force specifically warns of seizure and prosecution for unauthorized cannabis or CBD imports; lawful prescribed traveler medicines are a separate route.
