Cannabis laws in Barcelona, Spain
Tolerated, not legal
There is no legal recreational cannabis market in Barcelona, and joining a cannabis club does not make its supply lawful.
Official sources checked November 6, 2026. This is news information, not legal advice. Laws and local penalties change — confirm with the destination's official sources before you travel.
Before you fly
Carrying cannabis across a border is treated separately from possessing it inside the country. Even where buying is legal, taking it onto a plane can be a customs or smuggling offence, and a domestic flight can become an international one the moment you connect somewhere else.
Current law at a glance
- Buying as a visitor
- There are no licensed recreational shops. Private associations are not automatically unlawful, but registration does not authorize producing or distributing cannabis. Supreme Court case law treats organized club supply as potentially criminal, and narrow shared-consumption ideas are not a tourist purchase entitlement.
- Possession
- Spain sets no statutory gram allowance that makes recreational possession lawful in public. Private personal consumption generally sits outside criminal punishment, while possession intended for trafficking is criminal. Public possession stays an administrative offence even with no trafficking intent.
- Smoking in public
- National law bans illicit consumption or possession in public places, roads, public establishments and collective transport. Those are serious administrative offences carrying €601–€30,000 under Articles 36.16 and 39 of Organic Law 4/2015 — a statutory range, not an automatic €30,000 fine. No separate Barcelona cannabis street fine was verified.
- Medical cannabis
- Royal Decree 903/2025 sets a specialist-prescription and hospital-pharmacy framework for standardized compounded cannabis preparations — not recreational flower sales. Automatic tourist access or recognition of a foreign cannabis prescription was not verified, and a foreign medical card does not authorize club purchases.
- Home growing
- There is no blanket home-growing right or verified plant allowance. Cultivation purely for private personal use is distinguished from criminal production or supply, but illicit growing visible to the public is separately punishable under Article 36.18 in the same serious-offence range of €601–€30,000.
- Borders
- Do not treat private-use tolerance as permission to import or export recreational cannabis. Controlled medicines need the applicable travel documentation: the medicines agency publishes a minimum ten-day processing period and a maximum three-month certificate validity, and the exact document depends on the journey and medicine.

Practical questions
Can I buy weed in Barcelona?
Not through a lawful retail market. A club invitation, membership fee or association registration is not proof that cannabis distribution is legal.

Can I smoke on the street or carry a small amount?
Public use and public possession are administrative offences, including small personal-use quantities. The statutory fine range is €601–€30,000, and there is no public-possession gram exemption.
Can I fly home with it?
Do not carry recreational cannabis abroad — club membership is not an export permit. Prescribed controlled medicines need the applicable Spanish paperwork plus compliance with destination and transit rules.

Can I bring prescribed cannabis into Spain?
Arrange the controlled-medicine travel certificate or permit through the medicines agency before you leave, allowing at least the published ten-day processing period. Do not assume a prescription or medical card alone is enough.

Can a visitor obtain medical cannabis locally?
The verified framework is medical, specialist-led and hospital-pharmacy based. A general tourist access right or automatic foreign-prescription recognition was not verified.

What about CBD?
A CBD label does not establish that a particular flower, edible or extract is lawful to sell, consume or carry across borders. Product-specific Spanish CBD rules were not verified — and Switzerland's threshold does not apply here.
