Cannabis laws in Lisbon, Portugal
Decriminalized
Portugal decriminalizes personal drug use and possession, but you cannot legally buy recreational cannabis in Lisbon.
Official sources checked November 6, 2026. This is news information, not legal advice. Laws and local penalties change — confirm with the destination's official sources before you travel.
Before you fly
Carrying cannabis across a border is treated separately from possessing it inside the country. Even where buying is legal, taking it onto a plane can be a customs or smuggling offence, and a domestic flight can become an international one the moment you connect somewhere else.
Current law at a glance
- Buying as a visitor
- There is no legal recreational retail system. Personal acquisition, possession and consumption are administrative offences, not lawful activities. Decriminalization covers the controlled drugs listed in the legislation rather than cannabis alone, and it does not legalize dealing.
- Possession and the ten-day reference
- There is no lawful possession allowance. Law 55/2023 clarifies that exceeding ten days' average personal consumption is an indication the purpose may not be personal use — not an automatic trafficking conviction. If exclusive personal use is established, the administrative system applies regardless of quantity. Current official gram conversions were not verified.
- Smoking in public
- Consumption stays an administrative offence, including in public; police can seize drugs and refer the case to a dissuasion commission. Outcomes include warnings, non-monetary measures and, where applicable, fines rather than an automatic street ticket. The original law publishes its lower fine band in escudos, and no current euro-denominated cannabis fine schedule or Lisbon-specific street fine was verified.
- Medical cannabis
- Medical cannabis is available only through pharmacies on medical prescription after clinical assessment, generally where conventional treatments failed or caused significant adverse effects. Automatic acceptance of a foreign cannabis prescription, or guaranteed short-stay tourist dispensing, was not verified.
- Home growing
- Personal cultivation remains criminal: the amended Article 40 provides up to three months' imprisonment or a fine of up to 30 day-fines. A day-fine is not a fixed €30 penalty, and medical-cannabis legislation does not let patients grow their own.
- Borders
- Decriminalized domestic possession is not permission to import or export recreational cannabis. Controlled medicines need advance checking of destination and transit rules plus proper documentation. No Portugal-specific cannabis import allowance for foreign visitors was verified — do not infer one from the ten-day personal-use reference.

Practical questions
Can I buy weed in Lisbon?
Not legally for recreation. Decriminalization means personal acquisition is handled administratively; it does not authorize cannabis shops or street sellers.

Can I smoke on the street?
It stays an administrative offence. Police may seize the substance and refer you to the dissuasion process. Neither public nor private personal consumption becomes lawful through decriminalization.
Is carrying more than ten days' supply automatically trafficking?
No. Under the 2023 clarification the quantity is an indication requiring assessment, and if the drugs are established as exclusively for personal use, administrative treatment applies regardless of quantity. There is still no legal possession allowance.
Can I fly home with it?
Do not carry recreational cannabis out of Portugal. For prescribed controlled medicines, check destination and transit-country requirements before travel — domestic decriminalization gives no export authorization.

Can I bring medical cannabis into Portugal or obtain it there?
Local medical dispensing needs a prescription and pharmacy supply. A specific visitor import allowance and automatic foreign-prescription recognition were not verified — get confirmation from the national medicines authority before bringing a controlled cannabis medicine.
