Cannabis laws in Madrid, Spain

Tolerated, not legal

Madrid has no legal recreational cannabis shops, and private-use tolerance does not legalize club sales or public possession.

Official sources checked November 6, 2026. This is news information, not legal advice. Laws and local penalties change — confirm with the destination's official sources before you travel.

Before you fly

Carrying cannabis across a border is treated separately from possessing it inside the country. Even where buying is legal, taking it onto a plane can be a customs or smuggling offence, and a domestic flight can become an international one the moment you connect somewhere else.

Current law at a glance

Buying as a visitor
Tourists have no lawful retail channel. Cannabis social clubs are not licensed dispensaries: national criminal law and Supreme Court supply case law apply in Madrid just as in Barcelona, and registration or membership does not authorize distribution.
Possession
There is no statutory public-possession allowance in grams. Private personal consumption generally is not criminally punished, but public possession is an administrative offence and possession for trafficking is criminal.
Smoking in public
Organic Law 4/2015 makes illicit public consumption and possession serious administrative offences punishable by €601–€30,000, covering public places and collective transport. A separate Madrid cannabis-specific municipal fine was not verified.
Medical cannabis
The 2025 national framework regulates standardized cannabis compounded preparations through specialist prescribing and hospital pharmacies. It is not a walk-in tourist dispensary system, and automatic visitor eligibility or foreign-prescription acceptance was not verified.
Home growing
No statutory plant allowance was verified. Private personal cultivation must be distinguished from criminal production or supply, and growing visible to the public is a serious administrative offence carrying €601–€30,000.
Borders
Private-use tolerance does not authorize recreational imports or exports. For prescribed controlled medicines, follow the medicines agency's travel-certificate or permit procedures plus destination-country requirements; it states a minimum ten-day processing period and maximum three-month document validity.
