Cannabis laws in Montevideo, Uruguay

Legal for adults

Uruguay's regulated cannabis is for registered citizens and permanent residents — tourists cannot buy it in pharmacies.

Official sources checked November 6, 2026. This is news information, not legal advice. Laws and local penalties change — confirm with the destination's official sources before you travel.

Before you fly

Carrying cannabis across a border is treated separately from possessing it inside the country. Even where buying is legal, taking it onto a plane can be a customs or smuggling offence, and a domestic flight can become an international one the moment you connect somewhere else.

Current law at a glance

Buying as a visitor
Decree 120/014 limits pharmacy purchases to registered adults meeting Uruguayan citizenship or permanent-residency requirements, so a tourist passport alone is not enough, and purchasers must attend an authorized pharmacy in person. The decree allows up to 10 grams weekly and 40 grams monthly — allowances for eligible registrants, not tourist entitlements.
Possession
Current Article 31 of Decree-Law 14.294 exempts possession and specified domestic handling of quantities intended for personal consumption, and up to 40 grams of marijuana is expressly treated as personal consumption. A judge weighs personal-use circumstances, so this is neither an automatic trafficking finding above 40 grams nor a tourist purchase right.
Smoking in public
The national decree bans smoking or keeping cannabis lit in enclosed public places and enclosed workplaces, including public transport, and in indoor or outdoor premises of health, educational and sporting institutions. Ordinary outdoor streets are not categorically banned by those provisions, but a current Montevideo-specific cannabis fine and a numerical national consumer fine were not verified.
Medical cannabis
The recreational pharmacy registry is not a medical-prescription scheme. Automatic recognition of foreign prescriptions and a verified visitor-specific medical dispensing route were not verified — get written guidance from the Ministry of Public Health before assuming a foreign prescription allows purchase or carriage.
Home growing
Registered eligible adults may grow up to six psychoactive female flowering plants per household, with an annual harvest no greater than 480 grams, and need citizenship or accredited permanent residency plus registration. That is not a home-growing right for short-term tourists.
Borders
No tourist export allowance was verified: the domestic 40-gram personal-use provision is not permission to import or export. Current Article 31 bans unauthorized import, export and transit with a basic penalty of two to twelve years' imprisonment, plus aggravated provisions. Commercial controlled-drug movements need ministry authorization and, for cannabis, the corresponding state regulator's licence.

Practical questions

Can I buy weed in Montevideo as a tourist?

Not through the legal recreational system. Pharmacy sales require eligible citizenship or permanent residency plus registration, and clubs and home cultivation are restricted to eligible registered participants.

Does the 40-gram rule mean tourists can legally buy 40 grams?

No. Article 31's personal-possession protection is separate from the rules governing lawful supply and registered pharmacy purchases.

Can I smoke on the street?

The national decree does not ban every ordinary outdoor street, but it does ban enclosed public places, workplaces and transport, plus health, educational and sporting premises even outdoors. Montevideo-specific extra restrictions and fines were not verified.

Can I fly home with cannabis bought in Uruguay?

No tourist export allowance was verified. Unauthorized export is an Article 31 offence carrying a basic statutory penalty of two to twelve years, and the 40-gram domestic personal-use provision does not exempt exports.

Can I bring cannabis or a foreign medical prescription into Uruguay?

Do not carry cannabis across the border without specific authorization. A foreign prescription alone was not verified as an import permission, and the published import/export procedure covers authorized entities rather than passengers.

What about CBD?

No blanket traveler exemption for CBD oils or other CBD products was verified. Do not infer border permission from a low-THC label — ask the Ministry of Public Health about the exact product before travel.
